General Terms and Conditions for TARGET Archery


1. Scope

These General Terms and Conditions (GTC) apply to all contracts concluded via the TARGET Archery e.U. webshop between the operator of the webshop (hereinafter referred to as "Seller") and the customer (hereinafter referred to as "Customer").


2. Contractual Partner

3. Conclusion of the Contract

The product presentations in the webshop do not constitute legally binding offers, but are merely an invitation to submit an offer by the customer. The customer submits a binding offer by successfully completing the ordering process in the webshop. The conclusion of the contract takes place when the seller accepts this offer by sending a confirmation by e-mail or delivering the goods. If the customer cancels his order after the conclusion of the contract and the seller has already started processing the order or costs arise due to the cancellation, the customer is obliged to bear these costs.

 

4. Prices and Shipping Costs

All prices in the webshop are in euros (€) and include statutory value-added tax. Shipping costs are not included in the displayed price and are calculated separately. These will be displayed to the customer before the completion of the ordering process.


5. Terms of Payment

Payment can be made in advance or by invoice. The seller reserves the right to exclude certain payment methods in individual cases.


6. Delivery

Delivery is made to the delivery address specified by the customer. The delivery time is usually 4-8 working days but may vary depending on the availability of the products. The seller is entitled to make partial deliveries if this is reasonable for the customer. If the customer places multiple orders and they have not yet been shipped, the seller reserves the right to combine these orders to reduce shipping costs and packaging materials. The customer will be informed about such a combination of orders.


7. Right of Withdrawal

The customer has a statutory right of withdrawal. The withdrawal period is 14 days from receipt of the goods. To exercise the right of withdrawal, the customer must inform the seller by means of a clear statement (e.g., by e-mail or letter) of his decision to withdraw from the contract. The goods must be returned or handed over without delay and in any case no later than 14 days from the day on which the customer informed the seller of the withdrawal.


8. Warranty and Liability

The statutory warranty rights apply. Insofar as the seller does not breach his contractual or legal obligations through intent or gross negligence, he is only liable for damages that were foreseeable due to the contractual use of the goods. Liability for damages resulting from negligence is excluded, insofar as no essential contractual obligations have been violated.


9. Data Protection

The seller collects, processes, and uses personal data of the customer only within the framework of legal provisions. Details on data processing can be found in the webshop's data protection declaration.


10. Final Provisions

Should individual provisions of these GTC be or become invalid, this does not affect the validity of the remaining provisions. The law of the Republic of Austria applies, excluding the UN Sales Convention. In the case of consumers with a permanent residence abroad, Austrian law does not apply insofar as the national law of the consumer contains provisions from which the consumer cannot deviate by contract to his disadvantage.
